1. DESCRIPTION

This project is a Section 1135 Continuing Authorities Program project and is authorized by Section 1135, of the 1990 Water Resources Development Act. The project area is located within Lake Worth Lagoon in Palm Beach County, Florida. The lagoon has experienced losses in seagrass, mangrove, and oyster habitats in the Lake Worth Lagoon due to federal dredging and filling activities associated with the Intracoastal Waterway (IWW) and Palm Beach Harbor Navigation Project (PBHNP). Additionally, habitat loss was exacerbated, if not directly caused, by discharges from C-51, a federally maintained and operated channel.

4. STATUS

A Feasibility Cost Sharing Agreement was executed in October 2015. The feasibility report was initiated in November 2015 and was approved in February 2018. The Project Partnership Agreement (PPA) was executed in August 2019. The construction contract was awarded in November 2023, with construction completion scheduled for February 2026.

Due to the $10 million limitation on federal participation, the current federal obligation amount is at the CAP limit of $10,000,000.00, reflected in the PPA, and the non-federal obligations are at $7,388,300.64. The estimated additional cost to complete the project is $900,000, without taking into consideration any potential request for equitable adjustment from the contractor at the completion of the contract.

Section 1135(b) of the Water Resources Development Act (WRDA) of 1986 project cost limit as modified by Section 1107(g)(4) of the WRDA 2024 and increase the cost limit from its current amount of $10 million to $15 million through a Project Partnership Agreement (PPA) amendment for the Lake Worth Lagoon Continuing Authorities Program (CAP) Section 1135 Project.

The United States Army Corps of Engineers (USACE) Jacksonville District (SAJ) will request that the Section 1107(g)(3) WRDA 2024 cost limit increase be applied to the Lake Worth Lagoon CAP Section 1135 Project, allowing an increase in the federal cost limit. The Non-Federal Sponsor (Palm Beach County) has requested that the new project cost limit be applied by correspondence on February 13, 2025.
