Corps issues $30,000 administrative penalty for permit noncompliance

JACKSONVILLE, Fla. – The U.S. Army Corps of Engineers Jacksonville District has issued a $30,000 administrative penalty to Concord Station, LLC, for noncompliance with a permit for a project in Pasco County, Fla.

The Corps issued the penalty to Concord Station, LLC, for the following violations of the Department of the Army (DA) permit number SAJ-2003-04222: 

  • Failure to complete wetland compensatory mitigation, including the creation of 1.84 acres of herbaceous wetlands, restoration of 3.73 acres of herbaceous wetlands and 4.18 acres of forested wetlands, and enhancement of 10.27 acres of upland buffer.
  • Failure to restore the authorized 0.25 acre temporary wetland impact to its previous condition.
  • Discharge of previously authorized fill material into 1.30 acres of wetland conducted after the Jan. 31, 2013, construction window expired.

These violations occurred within freshwater wetland habitats within the Anclote River Watershed.  Specifically, the project is positioned directly west of Highway 41 and north of State Road 54, in Sections 15, 21, 22, 27, 28 and 29, Township 26 south, Range 18 east, Pasco County, Fla.

The Corps can assess administrative penalties for violations of Department of the Army-issued permits.  Penalties can range from $110 to $32,500, with the maximum penalty for a single violation being $11,000.  Violations are evaluated for compliance importance and environmental importance.

The Jacksonville District has an ongoing compliance inspection program throughout Florida, Puerto Rico, and the U.S. Virgin Islands.  Areas of particular emphasis are:

  • The standard general condition requirement to transfer permits when any part of the property is sold.
  • Any special conditions attached to the permit.
